Terms and Conditions for PMAC Fitness Ltd – Personal Training & Online Coaching Services.

Welcome to PMAC Fitness Ltd (“we,” “us,” “our”). These Terms and Conditions (“Agreement”) govern the use of our personal training and online coaching services (the “Services”). By accessing, booking, or using any of our Services, you (“Client,” “you,” or “your”) agree to comply with and be bound by these terms.

1. Acceptance of Terms
By using or purchasing our Services, you agree to these Terms and Conditions. If you do not agree with any part of these terms, you should not use our Services. We reserve the right to update or modify these terms at any time without prior notice, and your continued use of our Services will constitute acceptance of those changes.

2. Services Provided
We offer personalised fitness coaching, online training programs, retreats, nutritional advice, and support services. These Services are delivered via email, Zoom, Instagram, Trainerize and may include one-on-one sessions, group coaching, training plans, and other materials as agreed upon.

3. Client Responsibilities

  • You agree to provide accurate and complete information about your health, fitness, and any medical conditions that may affect your participation in training.
  • You agree to follow the training plans, instructions, and advice given to you by your trainer or coach.
  • You must consult with a healthcare professional before starting any new fitness program, especially if you have any medical conditions or are pregnant.
  • You are responsible for maintaining your own fitness equipment and ensuring a safe workout environment.

4. Payment and Fees

  • All services are billed according to the pricing outlined on our website or as agreed upon with the Client.
  • Payments for services must be made in full prior to the commencement of any sessions or training programs unless otherwise agreed.
  • Any applicable taxes or fees will be added to the payment amount where required by law.
  • Payments can be made via credit/debit card or bank transfer
  • Payments are non-refundable, except in cases where we cannot provide the
    agreed-upon services due to our fault.

5. Cancellations and Refunds

  • If you need to cancel or reschedule a session, please provide at least 24 hours notice to avoid being charged.
  • No refunds will be issued for missed or canceled sessions, unless otherwise agreed.
  • If we need to cancel a session, we will reschedule it at a mutually agreeable time or offer
    a refund for that session.

6. Health Disclaimer
You acknowledge and agree that physical exercise, including the use of any fitness equipment or participation in any fitness program, carries some inherent risks. By engaging in our services, you understand and assume all risks associated with physical exercise. You should stop any activity that causes you discomfort or pain and inform your coach immediately.

We make no guarantees of specific results or outcomes from our services. Your progress depends on your adherence to the program, effort, and individual factors.

7. Online Coaching Disclaimer

  • Online coaching involves providing personalised coaching and advice remotely. While we strive to offer accurate and effective programs, results may vary for each individual.
  • We are not liable for any injury or negative outcomes resulting from following the online
    coaching program.
  • You are responsible for ensuring that your internet connection, devices, and equipment
    are adequate for participating in online coaching sessions.

8. Intellectual Property
All training programs, materials, videos, and content provided by us are the intellectual property of PMAC Fitness Ltd and are protected by copyright laws. You may not reproduce, distribute, or share any of the content without explicit written permission.

9. Privacy and Confidentiality
We are committed to respecting your privacy. Any personal information you provide will be used solely for the purposes of delivering our services and will not be shared with third parties without your consent. Please refer to our Privacy Policy for more details on how we collect, use, and protect your personal data.

10. Limitation of Liability

  • We are not liable for any injuries, damages, or losses incurred during the use of our services.
  • We are not responsible for any failure to perform our obligations due to circumstances beyond our control, such as technical difficulties, illness, or other unforeseen events.
  • You agree to indemnify and hold PMAC Fitness Ltd harmless from any claims, damages, liabilities, or expenses arising from your use of our services.

11. Termination of Services
We may terminate or suspend our services at any time for any reason, including but not limited to non-payment or failure to comply with these Terms and Conditions. In such cases, we will notify you of the termination and may offer a prorated refund for services not rendered.

12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

13. Dispute Resolution
In the event of a dispute, we encourage you to contact us first to resolve the matter amicably. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration or mediation, as agreed upon by both parties.
